1. Who you're contracting with

These terms govern your use of PitchForge (the "Service"), operated by PitchForge ("we", "us"). By using the Service you agree to these terms. If you accept them on behalf of an organization, you confirm that you have authority to bind that organization. You must be at least 18 years old.

2. The service

PitchForge is a software tool that lets founders practice investor pitches with AI-generated investor personas, receive structured feedback, and share scorecards. The AI responses are generated by third-party large language models. They may be inaccurate or out of date and are not investment, legal, financial, or tax advice. You remain responsible for your decisions and for verifying anything material before acting on it.

3. Acceptable use

You agree not to:

use the Service unlawfully, fraudulently, or to send spam;
infringe anyone's intellectual property or privacy;
upload malware, probe, scan, scrape, or interfere with the Service's security;
misuse the AI features to generate illegal content, deepfakes, hate speech, harassment, or to jailbreak the underlying models;
resell, redistribute, or reverse engineer the Service.

You are responsible for the content of your prompts, for verifying outputs, and for ensuring you have rights to any material you upload (e.g. pitch decks). We may remove content or suspend accounts that violate these terms.

4. Accounts

You must keep your credentials confidential and provide accurate account information. You are responsible for activity under your account.

5. Intellectual property

We retain all rights in the Service, including the software, design, and branding. Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your own pitch practice. You retain all rights in the content you input; you grant us a limited license to host and process that content solely to provide the Service to you.

6. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy.

Paid plans renew automatically each billing period until canceled. You can cancel at any time from your account or via the customer portal; cancellation takes effect at the end of the current period.

7. Service level

The Service is provided "as is". We do not guarantee that it will be uninterrupted, error-free, or that AI outputs will meet your expectations. To the fullest extent permitted by law we disclaim all implied warranties including merchantability and fitness for a particular purpose.

8. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated policy violations. On termination your access ends; you may export your data for 30 days, after which it may be deleted.

9. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, goodwill, or fundraising outcomes. Nothing in these terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.

10. Indemnity

You will indemnify us against third-party claims arising from your content, your unlawful use of the Service, or your breach of these terms.

11. Changes

We may update these terms; material changes will be notified by email or in-product notice.

12. Governing law

These terms are governed by the laws of India. Disputes will be resolved in the courts of Bengaluru, India, except where mandatory consumer law gives you the right to bring a claim in your local courts.
